Regulations are rules and administrative codes issued by governmental agencies at all levels, local, state and federal. When legislative bodies like Congress pass a law, they often leave the details of implementation up to administrative agencies because certain decisions require expertise that may exist in the agency but not in Congress or other legislative bodies. Because they are adopted under authority granted by statutes, regulations are enforceable under the law and often include penalties for violations. Regulations are not as easily available to the public as other laws, but rulemaking processes generally provide for their publication in governmental journals such as the Federal Register.
Federal regulations are adopted according to the procedures in the Administrative Procedure Act (A.P.A.). States usually model their procedures on the A.P.A. These state-level administrative procedures describe how state regulations are developed and provide the legal framework for their implementation and interpretation.
