House Lobbying and Ethics Proposals Formally Announced

The House ethics proposals were announced yesterday and incoming House Speaker Nancy Pelosi reaffirmed promises of reform. The proposals included the creation of a panel within the Appropriations Committee that will oversee intelligence agencies and a House task force to consider establishing an outside ethics panel. The proposed rules changes include, "a ban on gifts and travel from lobbyists, preapproval from the ethics committee on all lawmakers' travel funded by outside groups, a ban on the use of corporate jets, and mandatory ethics training." Changes to the Lobbying Disclosure Act will most likely take longer to get to the House floor.

Leahy Pledges Oversight of Privacy and Human Rights Issues

As previously reported, the new chairman of the Judiciary Committee Senator Leahy plans to increase oversight of government programs, placing a high priority on privacy issues. BNA Money and Politics (subscription required) reported on Leahy's speech at Georgetown University Law Center. There are also plans to create a Subcommittee on Human Rights and the Law. Leahy was quoted in The New York Times saying, "the White House accelerated its power plays at the expense of the other branches of government — all in the name of fighting terrorism."

New FAQs On Exempt Groups
On December 5, the Internal Revenue Service (IRS) released a new set of frequently asked questions for exempt organizations. The FAQs include answers such as where complaints about the activities/operations of tax-exempt organizations should be sent and whether contributions are deductible while an organization's application for tax exemption is pending. The new FAQs are available here.

Plans to Probe Privacy Issues

This New York Times article reports that Democratic leaders want to conduct increased oversight of counterterrorism programs, including wiretapping and data-mining programs. Senator Leahy made this opinion clear during a hearing yesterday questioning Robert S. Mueller III, director of the FBI. These investigatory plans are very encouraging.

Mr. Leahy said he was troubled by recent reports about the Department of Homeland Security’s use of a scoring system to rate the risk that people coming across American borders might be terrorists or criminals. He said the program and broader government data-mining efforts could make it more difficult for innocent Americans to travel or to get a job — without giving them a chance to know why they were labeled a risk.

Senate Electronic Campaign Filing Editorial

This editorial, "Dark Ages Disclosure" appeared in yesterday's Washington Post. "In an age when such reports can be filed with the click of a mouse, Senate candidates submit their disclosures on paper, with weeks of delay before they are transferred to a form available and searchable on the Internet. . . This delay is so obviously unjustified that we expected the legal glitch to be quickly fixed." It speaks of one clear-cut reform that the 109th Congress should pass before recess. S.1508 the Senate Campaign Disclosure Parity Act, for mandatory electronic filing of Senate campaign finance reports. This would make vital information accessible to the public.

Campaign Finance Reformers Advocate Quick Action

A bipartisan group of campaign finance reformers joined together yesterday at a press conference announcing their commitment to lobbying and ethics reform. BNA Money and Politics reports; "Sens. John McCain (R-Ariz.) and Russ Feingold (D-Wis.) and other lawmakers said at a press conference that they are working together on a strategy that will permit identical bills to be introduced in the House and Senate. McCain said he and other lawmakers will push for passage of a reform bill in the first two months of the 110th Congress." In addition, Senator Feingold stated plans of proposing restrictions on 527 groups. USA Today also reported on this press conference. Democratic consensus will prove to be difficult, particularly over such matters as banning privately funded travel. CQ Today (subscription required) outlines this highly debatable issue of banning travel paid for by organizations that employ lobbyists.

One of the reasons a travel ban is unlikely is heavy pressure from pro-Israel groups, among them the American Israel Public Affairs Committee (AIPAC), which has a long history of paying for congressional visits to Israel. As an alternative to banning all privately financed trips, Democrats might require preapproval of trips by each chamber’s ethics committee and continue the prohibition on lobbyist-funded travel. That could allow a wide range of educational and non-profit groups to continue to pay for lawmakers to travel the globe.

Rating for All International Travelers
Recent news reports have revealed that Americans that travel internationally are being rated under the Automated Targeting System which uses computer-generated scores to rate the risk they pose of being terrorists or criminals. The New York Times details that scores "are assigned to people entering and leaving the United States after computers assess their travel records, including where they are from, how they paid for tickets, their motor vehicle records, past one-way travel, seating preference and what kind of meal they ordered." This rating which was originally thought to have only applied to cargo will be held for forty years.

Reid To Revisit Old Senate Ethics Bill

Roll Call (subscription required) reports that Senate Majority Reid plans to initiate lobbying and ethics reform with a previous GOP-authored bill. This bill passed in the Senate was opposed by some Senators and advocacy groups for being too weak. By using the old bill, it can be brought straight to the floor because it already had broad support.

The Senate bill, which passed 90-8 in March, bans all gifts and meals from lobbyists, doubles the one-year cooling off period for staffers and lawmakers-turned-lobbyists, and requires lawmakers to receive preapproval from the Ethics Committee before taking privately funded trips.

FEC Will Allow Hearings of Accused Violators

BNA Money and Politics and Roll Call (subscription required) have reported on the FEC decision to go forward with a pilot program that allows those accused of violating campaign finance rules to have closed hearings whereby the commissioners will decide whether or not to take on the case. This change of enforcement procedures allows the accused to contest the charges. Some feel that this will only slow down the enforcement process. Two other measures were voted on:

FEC backed a policy statement and proposed regulation regarding parties who are accused of violating recordkeeping and reporting requirements and argue that they made their "best efforts" to comply with campaign finance law. . . .The FEC advanced a new policy that would reduce by up to 75 percent penalties for violators of campaign finance law that self-report their offenses.
