NCRP Report Confirms Return on Investment in Advocacy

New research from the National Committee for Responsive Philanthropy (NCRP), a national foundation watchdog organization, concludes that public policy work is an effective strategy to address societal issues. A majority of grantmakers have traditionally steered away from funding public policy, grassroots advocacy, and other civic engagement activities. However, studies continue to show that advocacy work is vital to advancing a nonprofit organization's mission. The NCRP finding that there is such a great return on investment in advocacy could resonate with funders.

IRS Directive Broadens Scope of Prohibited Web Links on Issues

On July 28, the Internal Revenue Service (IRS) sent a memo to revenue agents that contradicts earlier guidance relating to 501(c)(3) organizations' use of web links for issue advocacy. The memo indicated that web links may be considered prohibited intervention in elections, depending on their context, the number of clicks between a site and a partisan message on the linked site, and whether an organization has a position on an issue and links to candidates' positions.

IRS Issues Final Version of New Form 990

On Dec. 20, 2007, the Internal Revenue Service (IRS) released the final version of its updated Form 990, the informational return for public charities and other tax-exempt organizations. The new form marked the first revision since 1979 and will be used for the 2008 tax year (returns filed in 2009). The IRS expects to release draft instructions for the 2008 Form 990 later in January. Although the new Form 990 incorporated many suggestions made in public comments on the draft version, the IRS did not make key changes to clarify and simplify reporting of advocacy-related activities.

Report Details Abramoff Abuse of Nonprofits, Recommends New Rules

An Oct. 12 report from Senate Finance Committee Ranking Member Max Baucus (D-MT) examines interactions between five tax-exempt organizations and disgraced lobbyist Jack Abramoff and his associates, finding instances of serious abuse. The report recommends a broad expansion of the definition of lobbying, increased disclosure requirements and enhanced penalties for violations. Its recommendations for further action by federal agencies with investigative and enforcement authority has received national attention. Receiving less media attention, however, is committee chair Charles Grassley's (R-IA) call for a more comprehensive examination of the role of nonprofits in lobbying and politics. Nonprofits thus will need to pay close attention to future committee action that could substantially affect nonprofit advocacy rights.
