Senate Quietly Passes Bill to Hide Torture Evidence

 

On Wednesday night, the Senate quietly passed legislation to exempt photographs of detainees being tortured by U.S. personnel from the Freedom of Information Act.  Further stunning the spirit of open government, they did so by unanimous consent.

Unsurprisingly, the Detainee Records Photo Protection Act of 2009 (S 1285) was sponsored by Sens. Lindsey Graham (R-SC) and Joseph Lieberman (I-CT).  Contrary to public statements made by the administration, Graham stated that White House Chief of Staff Rahm Emanuel made it clear that President Obama wanted to see legislative action to stop the release of the photos. 

What the administration is saying to the public is not what it is saying behind closed doors.  This action follows yesterday morning’s Congressional hearing held by the Senate Judiciary Committee.  Attorney General Eric Holder testified that the administration would appeal the issue to the Supreme Court and if unsuccessful would review their opinions on the matter.  However, Graham stated during the hearing that he had spoken with Emanuel, "He's indicated to me that (Obama) will not let these photos see the light of day."  Before the Senate vote on the bill, Graham elaborated that Obama “would sign…an executive order” to classify the photographs. 

Since the bill passed so easily in the Senate it can be expected to pass through the House without impediment.  However, the House may take it up as an amendment to the Defense Department authorization bill (HR 2647).

The most tragic part of this cover up is the abrupt turnabout from campaign promises to create the most open Administration in the history of the USA, and the way in which the charge has been led by Republicans (including one fake Democrat). The ongoing kowtowing to Republicans and Corporations has changed "Change" to more of the same old Bush policies. To use an old french saying: "Plus ca change - Plus c'est la meme chose" - The more it changes , the more its the same thing. The promises to hold the past Administration accountable have dissolved into ashes, solidly blocked by the failure to appoint a special Prosecutor, and the deliberate hiding of evidence, by monkeying with the FOIA. This contrasts sharply with the appointment a special Prosecutor by the Republicans in their efforts to displace a popular President for having an affair ( Something which many members of Congress have almost certainly covertly had, although only a few have been exposed). To fail to investigate and prosecute the heinous crimes against humanity, including some of the most horrific tortures resulting directly in the death of shackled prisoners, is to shame America, its Government and its Judicial System. The very thought of an innocent taxi driver receiving such a beating on the legs which resulted in an autopsy finding of all the muscles of his legs having been reduced to pulp over a 4 day period, makes one shudder to even think about it. The photo of a prisoner lying on the floor with his amputated penis and testicles lying on the floor in front of him with a soldier tugging up on his arm is apparently not shocking enough to take action against those in the highest echelons of Government who fostered this type of abuse. What kind of human beings are we to try to block justice for these victims and their families? What kind of American values does this expose?
