A direct-final rule is published first as a final rule (without previous publishing as a proposed rule with a notice and comment period). The rule takes effect within a specified number of days unless adverse comments are received. If the agency receives even one negative comment, the agency must republish the document as a proposed rule and proceed with notice-and-comment rulemaking procedures. The agencies enact direct rules in order to expedite the rulemaking process when they believe the rules are non-controversial.
